Tuffley man cleared of drug charge after his fingerprints were found on plastic wrapping

Fingerprints on plastic bags containing cannabis did not prove a Tuffley man was intending to supply the drug, a jury decided. Nicholas Thomas was found not guilty of a drugs charge at Gloucester Crown Court on Thursday. The court heard the 27-year-old was found outside a friend's house in Emerald Close on June 3, last year when it was raided by police. Prosecutor Nick Fridd told the jury inside the home police found a black plastic bag, containing seven wraps of cannabis, along with electronic scales and a plastic tub. He said Mr Thomas had denied it was anything to do with him, but further forensic investigations showed 10 of his fingerprints were on the outer bag and a further 13 were on six of the seven wraps. He alleged that Mr Thomas was using torn up pieces of plastic bags to wrap the drugs, which would then be sold on. But defending, Matthew Harbinson, said all it proved was that Mr Thomas had been in contact with the bags and not the drugs itself. He told the jury: "He was searched outside and nothing was found on him, his home address was searched and nothing was found. "The prosecution's case provides that at some stage Nicholas Thomas touched some plastic bags. "It is accepted that there is no collaborative evidence – it is the fingerprints and fingerprints alone. "If you touch a plastic bag you are going to leave your fingerprints on it." The jury took less than an hour to acquit Mr Thomas, also of Emerald Close, of possession of cannabis with intent to supply.
